Appeal of Anti-Doping Rule Violation Upheld

Bonn, Germany – On 13 December 2004 the urine sample provided by South African Coetzee Wium (Powerlifting, -90kg), following an out-of-competition test, was found to contain testosterone or testosterone precursors, which are prohibited substances under the World Anti-Doping Code Prohibited List. In accordance with the IPC Anti-Doping Code, an expedited hearing took place and a sanction of two years ineligibility was imposed on Mr. Wium for an anti-doping rule violation.

On behalf of the athlete, two appeals to the above decision were lodged on 16 and 23 March 2005. The primary argument presented was that the sample collection procedure in this case did not meet the World Anti-Doping Code (WADC) International Standard for Laboratories and should render the adverse analytical finding invalid.

Following the Internal Appeal Hearing, the IPC made the following decision: the sanction imposed on 14 March 2005 was not in accordance with the IPC Anti-Doping Code, as a significant departure from the International Standard had occurred. Therefore, the appeal is upheld and the athlete reinstated to sport immediately.
